    GYLA launches strategic legal proceedings to protect the voting rights of Georgian emigrant citizens

    The Georgian Young Lawyers Association (GYLA) has appealed to the Constitutional Court on behalf of Georgian citizens living in France. The lawsuit concerns the amendment to the Election Code, which prohibits the opening of polling stations in Georgian embassies and consulates abroad.

    According to GYLA, the aforementioned regulation contradicts the universal right to vote guaranteed by the Constitution of Georgia and does not serve a legitimate purpose. The organization notes that the ban creates additional financial and social barriers for immigrants, which practically limits their participation in elections.

    GYLA also points out that for years, polling stations functioned precisely in diplomatic missions and the state had the resources to ensure the free expression of voters’ will. According to the organization, these areas are under Georgian jurisdiction, which allows for the safe conduct of elections.

    If the lawsuit is upheld, it will be possible to reopen polling stations in Georgian embassies and consulates abroad. GYLA notes that the Constitutional Court remains the main mechanism through which citizens can protect their electoral rights.

    In addition, the organization draws attention to the delay in the consideration of important cases in the Constitutional Court, which, in their opinion, undermines the effectiveness of human rights protection. GYLA plans to continue the legal dispute on this issue on behalf of other immigrant groups.
